H-2A Farmworker Housing in TexasBuilt to Meet Federal Housing Standards

Employers hiring seasonal agricultural workers through the federal H-2A visa program must provide housing at no cost that meets federal standards. The obligation is set out at 20 CFR 655.122(d), and for newly constructed housing the applicable standard is OSHA's temporary labor camp standard at 29 CFR 1910.142. Housing is typically inspected and certified before workers arrive.

Our units are built to meet H-2A housing standards — including private sleeping quarters, kitchen facilities, bathroom ratios, egress, and ventilation. Final certification is issued by the state workforce agency after an on-site inspection of the installed unit, so compliance is confirmed at your location before workers arrive.

We currently offer two units designed for H-2A housing: a 5-bedroom, 5-bathroom unit (1,193 sq ft) and an 8-bedroom, 4-bathroom unit (32' × 76'). Both include a full kitchen, living room, dining area, and utility room.

The employer is responsible for requesting and passing the housing inspection conducted by the state workforce agency. We support you with unit specifications, floor plans, and documentation to help the inspection go smoothly.

Most likely yes, and it is separate from the federal H-2A process. Under the Texas Migrant Labor Housing Facility Act, a TDHCA license is required to establish, maintain or operate a migrant labor housing facility — defined as housing used for more than three days by two or more seasonal, temporary or migrant families, or three or more seasonal, temporary or migrant workers, whether or not rent is charged. The employer providing the housing is responsible for obtaining and maintaining that license. TDHCA licenses this housing regardless of whether it has been licensed, permitted or inspected by any other agency, so passing the TWC inspection for your H-2A application does not take the place of it. The application is submitted before the facility goes into operation, and the license and decal are posted at the entrance. Worth knowing: the standard fee is $250 per facility, but drops to $75 if you submit a TWC or DOL inspection less than 90 days old with no material deficiencies, along with a signed Certification of Texas Standards. One license can also cover multiple buildings on scattered sites if they are a reasonable distance apart and operated as one facility.
